1. Eligibility

You must be at least 13 years old to use FitUp. By using the App, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.

2. Account Registration

• You may register using your email and password, a one-time password (OTP) sent to your email, or your Google account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and truthful information when creating your profile.
• You may not transfer your account to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

3.1 Permitted Use

You may use FitUp to:

• Record and track your fitness routes and activities.
• Share your workouts and activities with other users.
• Follow other users, interact with posts, and participate in groups.
• Import and export GPX route files.

3.2 Prohibited Conduct

You may not:

• Post content that is illegal, harmful, defamatory, harassing, or obscene.
• Impersonate another person or entity.
• Use the App to send spam, unsolicited messages, or advertisements.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Scrape, crawl, or extract data from the App without written permission.
• Use the App for any commercial purpose without our prior written consent.
• Interfere with the App's functionality or infrastructure.

4. User-Generated Content

4.1 Your Content

You retain ownership of the content you post (text, images, videos, routes). By posting content, you grant FitUp a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content within the App for the purpose of operating and improving the service.

4.2 Content Standards

You are solely responsible for your content. Content must not:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any third party.
• Contain personal or private information of others without their consent.

4.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem harmful to the community, without prior notice.

5. Location Data

FitUp uses your device's GPS to track fitness routes. Location tracking occurs:

• Actively during a workout session (foreground).
• In the background when you start a route recording session — a foreground notification is shown while background tracking is active.

You control location permissions through your device settings. Disabling location access will limit core tracking features.

6. Health and Fitness Disclaimer

FitUp is not a medical application. Fitness data and statistics are for informational and motivational purposes only.

• Do not use FitUp as a substitute for professional medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare provider before starting any new fitness program.
• We are not liable for any injury or health consequence resulting from use of the App.

7. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms:

• Supabase — backend infrastructure and authentication — supabase.com/terms
• Mapbox — map rendering and navigation — mapbox.com/legal/tos
• Google Sign-In — OAuth authentication — policies.google.com/terms
• OpenStreetMap / OSRM — geocoding and routing — openstreetmap.org/copyright

We are not responsible for the practices of these third-party providers.

8. Intellectual Property

All content, trademarks, logos, and software comprising the App (excluding user-generated content) are owned by or licensed to FitUp. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.

9. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion:

• Your profile and personal data will be removed from our systems.
• Content you have shared (posts, activities) may be deleted or anonymized per our Privacy Policy.

10. Termination

We reserve the right to suspend or permanently terminate your account if you:

• Violate these Terms.
• Engage in conduct that we determine, in our sole discretion, to be harmful to other users or the App.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any errors or defects will be corrected.
• The App is free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by applicable law, FitUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Our total liability to you for any claim shall not exceed the amount you paid us in the past twelve (12) months (or $0 if the App was used free of charge).

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the competent courts of the jurisdiction in which we operate.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
